N.J.S.A. 2C:40-26 requires a mandatory minimum jail term of 180 days, for anyone convicted of driving while suspended due to a D.U.I. The statute applies a second driving while suspended conviction for a first DUI offender, and every driving while suspended conviction for someone who has been convicted of a second or more D.U.I.
